Terms of Service

By accessing or using WhaleClean (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Service.

WhaleClean provides a Windows PC optimization application available in a free tier and paid Pro plans. Pro features are unlocked via a license key issued upon successful payment.

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activity under your account. If you suspect unauthorized access, notify us immediately via the contact form in your dashboard.

We reserve the right to terminate accounts that violate these terms or are used for fraudulent purposes.

Upon purchasing a Pro plan, WhaleClean grants you a non-exclusive, non-transferable, revocable license to use the software for the duration of your subscription on a single personal computer (or, for Enterprise plans, the number of seats specified in your agreement).

You may not sublicense, sell, resell, transfer, assign, or commercially exploit the software or any license key. License keys are personal and must not be shared publicly.

You agree not to:

• Reverse-engineer, decompile, or disassemble the software
• Use the Service to harm, threaten, or harass others
• Attempt to bypass or circumvent license verification or authentication systems
• Use automated tools to create accounts or abuse the checkout system
• Violate any applicable laws or regulations

Pro plans are billed according to the selected billing cycle (monthly or yearly). All payments are processed by Stripe, Inc. By purchasing, you agree to Stripe's terms of service.

Prices are shown in USD and are subject to change. We will provide reasonable notice before changing the price of an active subscription.

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period.

Our refund policy is described in the Refund Policy. In summary, we issue refunds only when the issue is demonstrably on our side.

All intellectual property rights in the Service, including but not limited to the software, website content, logos, and trademarks, are owned by WhaleClean or its licensors. Nothing in these Terms grants you any right to use our trademarks or branding.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, WhaleClean shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

We reserve the right to update these Terms at any time. Material changes will be communicated by updating the effective date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with applicable law. Any disputes will be resolved through good-faith negotiation before resorting to formal proceedings.
